David Bain Bail Conditions Varied Ahead Of Retrial

Wellington, Feb 20 NZPA - The conditions of David Bain's bail have been amended, allowing him to travel to Christchurch and remain there ahead of a retrial scheduled for early March.

Further details of Mr Bain's bail arrangements, including where he was staying in Christchurch, were suppressed, according to a note by Justice Graham Panckhurst today following a week of pre-trial argument in the High Court at Christchurch.

A retrial on Mr Bain's murder charges is due to begin in Christchurch on March 2.

He was found guilty at his first trial in 1995 on charges of murdering five members of his family in Dunedin in 1994, and served 13 years before the Privy Council decided a new trial should be held.

When released from Christchurch Men's Prison in May 2007, he was bailed to supporter Joe Karam's home in Te Kauwhata, in northern Waikato, and later allowed to move to West Auckland.

Bail conditions had not allowed him to set foot in the South Island, Hamilton or Wellington, where extended family members lived.

He was granted "special bail" earlier this month to go to Dunedin to prepare for his trial.

In Christchurch today, Chief High Court Judge Tony Randerson and Justice Graham Panckhurst reserved their decisions on pre-trial arguments and a stay application to have all charges dropped against Mr Bain.

Their decisions are expected by the end of next week.

Mr Bain's defence team has also been granted an appearance at the Supreme Court in Wellington on Monday on a different matter. All details will be suppressed.
